1. Acceptance and scope
These terms apply to website use and to services supplied by The Wictory, together with the applicable proposal, quotation, statement of work, invoice or written agreement. Project-specific written terms prevail where they conflict with general website terms.
2. Proposals, payments and timelines
Scope, deliverables, fees, billing cycle and timelines are defined in writing. Work may begin after the agreed advance or invoice is received. Client delays in approvals, content, access or feedback may change delivery dates. Overdue work, campaigns, hosting or support may be paused.
3. Client responsibilities
The client must provide lawful, accurate material and necessary approvals. The client is responsible for claims, products, regulatory permissions and account information supplied to us.
4. Intellectual property and unpaid work
Unless otherwise agreed in writing, final approved deliverables created specifically for the client are licensed or assigned only after all related invoices are paid in full. Drafts, strategy, copy, designs, code, campaigns or other content supplied by The Wictory must not be published, reproduced, transferred, modified or commercially used while payment remains outstanding. Pre-existing tools, frameworks, templates, know-how, third-party assets and reusable components remain the property of their respective owners.
5. Development, hosting and access
Development work is customized and its payments are non-refundable once work has commenced, except where required by applicable law or expressly agreed in writing. Where a website is hosted on The Wictory’s shared or managed server environment, cPanel or master hosting access is not provided. The client may receive project-specific FTP credentials where technically available and appropriate. Domain, premium plugin, licence, cloud, API, stock asset and third-party charges are separate unless expressly included.
6. Marketing results and platforms
We apply professional skill and agreed processes but do not guarantee rankings, leads, sales, platform approvals or uninterrupted third-party services. Search engines, advertising platforms and social networks control their own systems and policies.
7. Suspension and termination
Either party may terminate as stated in the applicable agreement. Completed work, notice-period charges, committed resources, non-cancellable costs and outstanding invoices remain payable. Refund eligibility is governed by our Refund Policy and applicable law.
8. Liability and governing law
To the extent permitted by law, indirect or consequential loss is excluded and aggregate liability is limited to the fees paid for the affected service. These terms are governed by Indian law, with disputes subject to the competent courts serving Zirakpur/Panchkula Tricity, unless mandatory law requires otherwise.
